Terms & Conditions

ALL ORDERS are placed subject to the following terms and conditions.

1. ACCOUNTS Invoices are to be sent to the Registered Office and marked clearly with order No.and Code No. unless otherwise stated on the order

No account will be passed for payment for goods or services supplied to this Company unless a formal order has been placed for same. A monthly statement of account must be rendered not later than the 10th of the following month.

Non compliance with the instructions as to invoices and monthly statements will occasion delay in payment of your account.

2. EACH DELIVERY of material supplied against this order is to be subject to the approval of the Buyer, or as arranged, and any material rejected by him or his representative is to be removed from the site by the Seller at his own expense. Such expense will include all costs involved in handling by the Buyer.

3. DESPATCH An Advice Note is to be sent with the goods bearing Order No. and Code No. shown on the order. They should give such particulars as will enable our stores or site representative to check the delivery, method of delivery, truck number, etc.

4. NO PAYMENT will be made for cases not returned unless they are marked “Returnable” and the address given to where they are to be returned.

5. ALL ORDERS written on continuation sheets are subject to the same terms and conditions as on the first sheet.

6. ACKNOWLEDGEMENT OF ORDER Orders must be accepted in writing or delivered within 7 days of receipt of Order. Failure to do so will render the Order liable to cancellation.

7. INSPECTION AND TESTING We reserve the right to request Certified Test Sheets, and also to inspect and test goods during manufacture.

8. DELIVERY DATES We reserve the right to cancel all or part of the Order if the delivery date is not complied with as stated on the Order.

9. REJECTION The Buyer may by notice in writing to the Seller reject the goods if the Seller fails to comply with his obligations under Clauses 2 and 7 hereof and may also by notice in writing to the Seller, given within 7 days of delivery, reject any goods which are found not to be in accordance with the Order.

10. QUALITY AND INSPECTION The goods shall conform to quantity, quality and description as agreed and be of sound materials and workmanship and be equal to samples, patterns or specifications.

11. PACKING AND DESCRIPTION The goods shall be packed/crated and protected in such a manner as to reach their destination in good condition under normal conditions.

12. HEALTH AND SAFETY All goods and materials supplied must comply with the amendments to Section 6 of the Health & Safety at Work Act & the Consumer Protection Act, Section 36 and safety data sheets must be provided as applicable.

13. ASSIGNMENT AND SUB-CONTRACTING

  1. The Seller shall not without consent in writing of the Buyer assign or transfer the Contract or any part of it to any other person.
  2. The Seller shall not without the consent in writing of the Buyer sub-let the Contract or any part thereof, other than for materials, minor details or for any part of the goods, for which the makers are named in the Order or the Specification. Any such consent shall not relieve the Seller of anyof his obligations under the Contract.
